Terms and Conditions for Employee Participation and Release of Liability I hereby state that I am an employee of a member business or organization which is a member in good standing of the Charles River Transportation Management Association (CRTMA). I have read, understand, and agree to the Eligibility, Use Protocol and Procedure for Participation in CRTMA’s Emergency Ride Home Program. By signing below, I attest to my understanding and agreement that CRTMA does not have nor does it assume responsibility or liability for any aspect of the transportation provided by my transportation vendor of choice. Further, CRTMA has no control over the quality or safety of transportation provided by my vendor of choice and no control over the truth or accuracy of information provided by my vendor of choice. I understand and agree that I engage the services of my vendor of choice at my own individual risk. I take full responsibility for selecting a vendor, contracting for service and for payment to the vendor in full for the completed trip. I understand that CRTMA, its member organizations and my employer are not responsible for the performance of or payment to the transportation vendor of my choice. CRTMA is not a party to any agreement for transportation services, whether express or implied, between me and my vendor of choice. CRTMA does not represent or endorse, has no relationship to and shall not be liable for any actions, inactions, errors, or omissions of my vendor of choice. CRTMA expressly disclaims all liability for the actions, inactions, errors, or omissions of my vendor of choice. The within disclaimers form a material and essential part of the within Terms and Conditions for Employee Participation in CRTMA’s Emergency Ride Home Program. I understand that within the parameters of the Use Protocol and Procedure for Participation outlined above, CRTMA offers to reimburse me for the cost of transport from work to home in the event of an eligible emergency. I understand that I contract with my vendor of choice for a ride home and not with CRTMA. CRTMA is not responsible for any disputes, claims, losses, injuries, damages or fees of any kind that may arise between me and my vendor of choice as a result of my contract with and the provision of services by my vendor of choice. I hereby certify that I am a competent adult and I of my own free will assume all risks to person and property associated with contracting for a ride home with my vendor of choice, being under no compulsion or duress. I understand that CRTMA is not responsible for my safety or my comfort in connection with contracting with a transportation vendor of my choice for a ride home. I acknowledge that CRTMA’s sole offer is to reimburse me for the cost of the ride home contingent upon my participation in the Emergency Ride Home program in accordance with Use Protocol and pursuant to the Program Procedure outlined above. I understand and agree that CRTMA makes no other offer, whether express or implied, whether in law or in equity, in connection with my use of the Emergency Ride Home Program. CRTMA has no control over the acts or omissions of my vendor of choice and/or its drivers and CRTMA is not responsible for the conduct or performance of my vendor of choice. I understand that CRTMA may withdraw the offer to reimburse me for the cost of a ride home if I do not follow the Use Protocol and the Procedure for Participation outlined above. Misuse or abuse of the Emergency Ride Home Program may result in the loss of my eligibility to continue participation . I understand that upon reasonable notice CRTMA may alter, amend, modify or terminate the Emergency Ride Home Program at its sole and exclusive discretion. By selecting the “Submit” button below, I request participation in the Charles River Transportation Management Association's (CRTMA) Emergency Ride Home Program ("Program"). I certify and attest that I have read and understand the Eligibility requirements, the Use Protocol, the Procedure for Participation and the within Terms and Conditions for Employee Participation in the Emergency Ride Home Program and I voluntarily, willingly, and knowingly and without reservation agree to abide by the them. If any of the above Terms and Conditions for Employee Participation in CRTMA’s Emergency Ride Home Program are not understood, accepted and agreed to, CRTMA specifically requests that you do not participate in the Emergency Ride Home Program. It is a condition of participation in the Emergency Ride Home program that the within Terms and Conditions are understood, accepted and agreed to by all participants.
